Privacy One-Pager
Data protection is a matter of trust and your trust is important to us. We respect your privacy and personal sphere. Protecting and collecting, processing and using your personal data in accordance with the law is therefore an important concern for us. To ensure that you feel secure when visiting our websites, we strictly observe the statutory provisions when processing your personal data and would like to inform you here about our data collection and data usage.
You can print or save this document by using the standard functionality of your internet browser (usually "File" -> "Save as"). You can also download and archive this document in PDF format by clicking here. To open the PDF file, you need the free Adobe Reader program (available at www.adobe.de) or a comparable program that can open PDF files. The following privacy policy explains which data is collected on our websites and how we process and use that data.
1. DATA CONTROLLER
The data controller responsible for the collection, processing and use of your personal data within the meaning of the Federal Data Protection Act is Chice-Schuhe.de SE, Tamara-Danz-Str. 1, 10243 Berlin (hereinafter: Chice-Schuhe.de). If you wish to object to the collection, processing or use of your data by Chice-Schuhe.de in accordance with these data protection provisions, either in total or for individual measures, you can send your objection by e-mail, fax or letter to the following contact details: Chice-Schuhe.de - Sami Akcamur - Alte Land Strasse 9 – D-78112 St. Georgen-Tel: 07724-8844581-e-mail: akcamur@outlook.com. In addition, you can of course request information about the data stored by us at any time free of charge (please see point 11 for more on this).
2. COLLECTION, PROCESSING AND USE OF PERSONAL DATA
2.1 PERSONAL DATA
Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name, your telephone number, your address, as well as all master data that you provide to us when registering and creating your customer account. Statistical data that we collect, for example, when you visit our web shop, and which cannot be directly linked to your person, are not included here. Examples of this are statistics on which pages of our shop are particularly popular or how many users visit specific pages of the Chice-Schuhe.de shop.
2.2 CUSTOMER ACCOUNT
For every customer who registers accordingly, we set up password-protected direct access to their stored master data (customer account). Here you can view data about your completed, open and recently shipped orders and manage your data and the newsletter. You agree to treat your personal access data confidentially and not to make it accessible to unauthorized third parties. We cannot accept liability for misused passwords, unless we are responsible for the misuse. Unless you log out, you will remain logged in automatically. This function allows you to use some of our services (e.g., 'Your Ayara.de') without having to log in again each time. For security reasons, however, you will be asked to enter your password again if, for example, your personal data is to be changed or you wish to place an order.
2.3 COLLECTION, PROCESSING AND USE OF YOUR PERSONAL DATA
Data protection is very important to us. Therefore, when collecting, processing and using your personal data, we strictly adhere to the legal provisions of the Federal Data Protection Act and the Telemedia Act. We collect, store and process your data for the entire processing of your purchase, including any subsequent warranties, for our services, technical administration and our own marketing purposes. Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract fulfillment or billing or if you have previously consented. As part of order processing, the service providers we use here (such as carriers, logistics companies, banks) receive the necessary data for order and contract processing, for example. The data passed on in this way may only be used by our service providers to fulfill their task. Any other use of the information is not permitted and does not occur with any of the service providers entrusted by us. For your order, we need your correct name, address and payment details. We need your e-mail address so that we can confirm receipt of your order and communicate with you. We also use it for your identification (customer login). Furthermore, you will receive your order and shipping confirmation via your e-mail address. Your personal data will be deleted provided that legal storage obligations do not conflict and if you have asserted a claim for deletion, if the data is no longer required for the purpose pursued with the storage, or if its storage is inadmissible for other legal reasons.
2.4 USE OF YOUR DATA FOR ADVERTISING PURPOSES
In addition to processing your data to complete your purchase at Chice-Schuhe.de, we also use your data to communicate with you about your orders, specific products or marketing campaigns and to recommend products or services that might interest you. You can object to the use of your personal data for advertising purposes at any time, either in total or for individual measures, without incurring any costs other than the transmission costs according to the basic rates. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose.
2.4.1 NEWSLETTER
For the mailing of the newsletter, we use the so-called double opt-in procedure, i.e., we will only send you a newsletter via e-mail once you have explicitly confirmed to us that we should activate the newsletter service. We will then send you a notification e-mail and ask you to confirm that you would like to receive our newsletter by clicking on a link contained in this e-mail. If you later decide you no longer wish to receive newsletters from us, you can object to this at any time without incurring any costs other than the transmission costs according to the basic rates. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Naturally, you will also find an unsubscribe link in every newsletter.
2.4.2 PRODUCT RECOMMENDATIONS VIA E-MAIL
As a Chice-Schuhe.de customer, you will regularly receive product recommendations from us via e-mail. You will receive these product recommendations from us regardless of whether you have subscribed to a newsletter. In this way, we want to provide you with information about products from our range that might interest you based on your recent purchases with us. We adhere strictly to the legal requirements. If you no longer wish to receive product recommendations or any advertising messages from us at all, you can object to this at any time without incurring any costs other than the transmission costs according to the basic rates. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Naturally, you will also find an unsubscribe link in every e-mail.
2.4.3 INDIVIDUALIZED ADVERTISING FOR YOU
Information we receive from you helps us to continuously improve your shopping experience and to make it customer-friendly and tailored to you. The information you transmit and that is automatically generated is used to create advertising tailored to you and your interests. For this purpose, we use existing information, such as receipt and read confirmations of e-mails, information about your computer and connection to the internet, operating system and platform, your order history, your service history, the date and time of your visit to our homepage, and products you have viewed. We use this information exclusively in pseudonymized form. Through the analysis and evaluation of this information, we are able to improve our websites and our online offering, and to send you individualized advertising as a result. This means advertising that recommends products that you might actually be interested in. Our goal is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the pseudonymized data collected from you helps us ensure that we do not send you indiscriminate advertising. Instead, we send you advertising, such as newsletters, product recommendations, via e-mail or direct mail, that corresponds to your areas of interest. In this respect, for example, we also compare which of our advertising e-mails you open to avoid sending you unnecessary e-mails. Chice-Schuhe.de uses the data provided by me and other information stored for my customer account, as well as pseudonymized usage data, to present me with personalized advertising and/or special offers and services. If you do not wish to receive personalized advertising, you can object to this at any time in total or for specific measures. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose.
2.4.4 COMPETITIONS, MARKET AND OPINION RESEARCH
In the case of competitions, we use your data for the purpose of notifying you of winnings and for advertising our offers. You can find detailed information, if applicable, in our terms and conditions for the respective competition. We also use your data for market and opinion research. Of course, we use this data exclusively in anonymized form for statistical purposes and only for Ayara.de. Your responses to surveys will not be passed on to third parties or published. Chice-Schuhe.de uses and processes my personal data for market and opinion research for its own purposes. You can object to the use of data for market and opinion research at any time, either in total or for specific measures, without incurring any costs other than the transmission costs according to the basic rates. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Naturally, you will also find an unsubscribe link in every survey e-mail.
3. CREDIT CHECK
We conduct a credit check before concluding a purchase contract. This is done to be able to offer you a selection of different payment methods and, at the same time, to protect ourselves against default for payments on account and by direct debit. In addition, the credit check serves your safety and ours, as it prevents fraud and other criminal offenses. As part of the credit check, we examine all data available to us and determine which payment methods can be offered for an order. Among other things, all previous orders in your customer account are checked. In addition, it is also checked whether the delivery address deviates from the billing address, whether it is a new delivery address, or whether the order is to be delivered to a "Packstation". In addition to the data available to us, data from external service providers is also required. For this purpose, we transmit the personal data required for a credit check (first and last name, your address, and, if applicable, your date of birth) to the following credit agency: infoscore Consumer Data GmbH, Rheinstraße 99, 76532 Baden-Baden
This credit agency uses the aforementioned data transmitted by us to make a corresponding assessment of your creditworthiness regarding the respective order on the basis of mathematical-statistical procedures (scoring). Furthermore, the credit agency uses the aforementioned data for other companies (e.g., other online retailers) for the purposes of address verification or identity checks, as well as for scoring applications based on this. Your address data also flows into the calculation of the probability value. Under certain circumstances, it is possible to draw conclusions about negative indicators. As part of the ordering process, we also compare your bank details (only IBAN and BIC or account number and bank sort code) with the Return-debit Prevention Pool (RPP) of infoscore Consumer Data GmbH (ICD), Rheinstr. 99, 76532 Baden-Baden. The RPP functions as a blocking file. Furthermore, in the event of a failed direct debit, we will, as far as permissible, report your bank details (only IBAN and BIC, no personal data) to the RPP of the ICD, which will transmit this block to other companies participating in the information procedure upon request. After payment of the returned debit, we will report the settlement to the RPP. If you do not agree with the payment method(s) offered to you, you can inform us of this in writing by letter or by e-mail to akcamur@outlook.com. We will then re-examine the decision while taking your point of view into account. You can revoke your consent at any time with effect for the future by notifying us in writing or in text form at akcamur@outlook.com, and you can also receive information about the data stored by us and our credit agency (at the addresses mentioned above).
4. COOKIES
Accepting cookies is not a prerequisite for visiting our websites. However, we would like to point out that our website and service have limited functionality if you do not allow us to set cookies.
What are cookies? Cookies are small files that are stored on your data carrier and save certain settings and data for exchange with our system via your browser. Basically, there are 2 different types of cookies: so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period or indefinitely. This storage helps us to design our websites and our offers for you accordingly and makes it easier for you to use, for example, by saving certain inputs so that you do not have to repeat them constantly.
Which cookies does Ayara.de use? Most of the cookies we use are automatically deleted from your hard drive after the end of the browser session (end of the session) (hence the name "session cookies"). Session cookies are required, for example, to offer you the shopping cart function across multiple pages. In addition, we also use cookies that remain on your hard drive. When you visit us again, it is then automatically recognized that you have already been to our site and which inputs and settings you prefer. These temporary or permanent cookies (lifespan of 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies, in particular, serve to make our offer more user-friendly, effective and secure. Thanks to these files, it is possible, for example, to have information displayed on the site that is specifically tailored to your interests. The sole purpose of these cookies is to adapt our offer to your customer requirements as best as possible and to make browsing our site as comfortable as possible for you.
What data is stored in the cookies? Only pseudonymous data is stored in the cookies used by Ayara.de. When the cookie is activated, an identification number is assigned to it, and your personal data is not associated with this identification number. Your name, your IP address or similar data that would allow the cookie to be assigned to you are not inserted into the cookie. On the basis of cookie technology, we only receive pseudonymized information, for example, about which pages of our shop were visited, which products were viewed, etc.
What is Onsite Targeting? On the Chice-Schuhe.de websites, data is collected on the basis of cookie technology to optimize our advertising and our entire online offering. This data is not used to identify you personally, but serves solely for the pseudonymous evaluation of the use of the homepage. At no time will your data be merged with the personal data stored by us. With this technology, we can present you with advertising and/or special offers and services whose content is based on information obtained in connection with clickstream analysis (for example, advertising that is geared towards the fact that only sports shoes were viewed in the last few days). Our goal is to make our online offering as attractive as possible for you and to present you with advertising that corresponds to your areas of interest.
Are there also cookies from third-party providers (so-called third-party cookies)? Ayara.de uses some advertising partners who help to make the online offer and the websites more interesting for you. Therefore, cookies from partner companies are also stored on your hard drive when you visit the websites. These are temporary/permanent cookies that delete themselves automatically after the specified time. These temporary or permanent cookies (lifespan of 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time. The cookies from our partner companies also contain only pseudonymous, and in most cases even anonymous, data. These are, for example, data about which products you have viewed, whether anything was purchased, which products were searched for, etc. In doing so, some of our advertising partners also collect information beyond our websites about which pages you have visited previously or which products you were interested in, for example, in order to display advertising to you that best corresponds to your interests. This pseudonymous data is at no time merged with your personal data.

They are exclusively intended to enable our advertising partners to address you with advertising that might actually be of interest to you.
Re-Targeting Our websites use so-called re-targeting technologies. We use these technologies to make our website more interesting for you. This technique makes it possible to address internet users who have already shown an interest in our shop and our products with advertising on our partners' websites. We are convinced that the display of personalized, interest-based advertising is generally more interesting for the internet user than advertising that has no such personal connection. The display of these advertisements on our partners' websites is based on cookie technology and an analysis of previous usage behavior. This form of advertising is carried out entirely pseudonymously. No usage profiles are merged with your personal data. By using our site, you consent to the use of such cookies and to the collection, storage, and use of your usage data. Furthermore, your data will be stored in cookies beyond the end of the browser session and can be accessed again, for example, during your next visits to the websites. You can revoke this consent at any time with effect for the future by refusing to accept cookies in your browser settings.
How can you prevent the storage of cookies?
You can set your browser so that cookies are only accepted if you agree to it. If you want to accept only Chice-Schuhe.de cookies but not the cookies from our service providers and partners, you can select the "Block third-party cookies" setting in your browser. As a rule, the help function in the menu bar of your web browser will show you how to reject new cookies and how to switch off ones you have already received. Detailed information on how you can adjust the settings in the browser you are using can be found via the following link. We recommend that you always log out completely after finishing if you are using a shared computer that is set to accept cookies and Flash cookies.
5. LOG FILES
Each time you access the pages of Ayara.de, usage data is transmitted by the respective internet browser and stored in log files, so-called server log files. The data records stored in this process contain the following data: date and time of retrieval, name of the page accessed, IP address, referrer URL (the source URL from which you arrived at the websites), the amount of data transferred, as well as product and version information of the browser used. User IP addresses are deleted or anonymized after use ends. In the case of anonymization, IP addresses are changed in such a way that the individual details about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person, or only with a disproportionately large amount of time, cost, and effort. We evaluate these log file records in anonymized form to further improve our offering and the Ayara.de shop and make them more user-friendly, to find and fix errors faster, and to manage server capacities. For example, it is possible to track when use of the Ayara.de shop is particularly popular and to make corresponding data volume available to ensure you the fastest possible shopping experience. Furthermore, by analyzing the log files, we can also identify and rectify any errors in the Ayara.de shop more quickly.
6. WEB ANALYSIS
6.1 GOOGLE ANALYTICS
Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies," which are text files stored on your computer that allow an analysis of the use of our offering by Google. The information generated by the cookie about your use of our websites (including your IP address) is generally transmitted to a Google server in the USA and stored there. We would like to point out that on our websites, Google Analytics has been extended by the code "gat._anonymizeIp();;" to ensure an anonymized collection of IP addresses (so-called IP masking). Your IP address is therefore only recorded by Google in truncated form at our request, which ensures anonymization and does not allow any conclusions to be drawn about your identity. If IP anonymization is activated on our websites, your IP address will be truncated by Google beforehand within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use the aforementioned information to evaluate your use of our websites, to compile reports on website activity for us, and to provide other services related to website and internet use to us. The IP address transmitted by your browser within the scope of Google Analytics will not be merged with other data by Google. A transfer of this data by Google to third parties only takes place due to legal requirements or within the framework of commissioned data processing. Under no circumstances will Google combine your data with other data collected by Google. By using these websites, you agree to the processing of data collected about you by Google in the manner and for the purpose described above. You can prevent the storage of cookies by adjusting your browser software accordingly; however, we point out that in this case, you may not be able to fully utilize all the functions of our websites. Furthermore, you can prevent the collection of the data generated by the cookie and related to your use of these websites (including your IP address) to Google as well as the processing of this data by Google by downloading and installing the browser plugin available at the following link. Further information on Google Analytics and data protection can be found at http://tools.google.com/dlpage/gaoptout?hl=de.
6.2 WEBTREKK
For the statistical evaluation of the websites, we also use the technologies of Webtrekk GmbH, Boxhagener Str. 76-78, 10245 Berlin (www.webtrekk.de). With the help of Webtrekk's services, we collect statistical data about the use of our website. This data is used to permanently improve and optimize the Chice-Schuhe.de shop and our offers and thus make them more interesting for you. Webtrekk GmbH has been certified by TÜV Saarland in the area of data protection for the web controlling software used by Chice-Schuhe.de. In particular, the collection and processing of tracking data was checked and certified for data protection compliance and data security. As part of the use of these websites, information transmitted by your browser is collected and evaluated. This is done through cookie technology and so-called pixels that are integrated into every page. The following data is collected: request (filename of the requested file), browser type/version, browser language, operating system used, inner resolution of the browser window, screen resolution, Javascript activation, Java on/off, cookies on/off, color depth, referrer URL, IP address (collected exclusively in anonymized form and deleted immediately after use), time of access, clicks, order values, shopping carts, and anonymized form contents (for example, whether a telephone number was provided or not). Direct personal identification is excluded at all times. The data collected in this way is used to create anonymous usage profiles, which form the basis for web statistics. The data collected with Webtrekk technologies will not be used to personally identify the visitor of these websites without the separately granted consent of the person concerned and will at no time be combined with personal data about the bearer of the pseudonym. You can object to data collection and storage by Webtrekk at any time with effect for the future. To do this, please call up the following link. By confirming the link, a so-called opt-out cookie is placed on your data carrier. This cookie is valid for 5 years. Please note that if all cookies on your computer are deleted, this opt-out cookie will also be deleted, meaning that if you wish to continue to object to the anonymized data collection by Webtrekk, you must set the opt-out cookie again. The opt-out cookie is set per browser and computer. If you visit our websites from home and work or with different browsers, you must activate the opt-out cookie in the different browsers or on the different computers.
7. DOUBLECLICK BY GOOGLE
Doubleclick by Google is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Doubleclick by Google uses cookies to present you with relevant advertisements. In this process, a pseudonymous identification number (ID) is assigned to your browser to check which ads have been displayed in your browser and which ads have been called up. The cookies contain no personal information. The use of DoubleClick cookies allows Google and its partner websites only to place ads based on previous visits to our or other websites on the internet. The information generated by the cookies is transmitted by Google to a server in the USA for evaluation and stored there. A transfer of the data by Google to third parties only takes place due to legal requirements or within the framework of commissioned data processing. Under no circumstances will Google combine your data with other data collected by Google. By using our websites, you agree to the processing of data collected about you by Google in the manner and for the purpose described above. You can prevent the storage of cookies by adjusting your browser software accordingly; however, we point out that in this case, you may not be able to fully utilize all the functions of our websites. Furthermore, you can prevent the collection of the data generated by the cookies and related to your use of the websites to Google as well as the processing of this data by Google by downloading and installing the browser plugin available at the following link under the item DoubleClick Deactivation Extension. Alternatively, you can deactivate Doubleclick cookies on the Digital Advertising Alliance page via the following link.
8. SOCIAL PLUGINS
8.1 SOCIAL PLUGINS
Our website uses social plugins ("plugins") from various social networks. With the help of these plugins, you can, for example, share content or recommend products. The plugins are deactivated by default on Chice-Schuhe.de and therefore do not send any data. You can activate the plugins by clicking on the "Activate Social Media" button. Naturally, the plugins can be deactivated again with one click. When these plugins are activated, your browser establishes a direct connection with the servers of the respective social network as soon as you visit a page on our website. The content of the plugin is transmitted by the social network directly to your browser and integrated into the website by it. By integrating the plugins, the social network receives the information that you have called up the corresponding page of our website. If you are logged into the social network, it can assign the visit to your account. If you interact with the plugins, for example by pressing the Facebook "Like" button or submitting a comment, the corresponding information is transmitted by your browser directly to the social network and stored there. For the purpose and scope of data collection and the further processing and use of the data by social networks, as well as your rights in this regard and setting options for protecting your privacy, please refer to the privacy policies of the respective networks or websites. You can find the links for this further below. Even if you are not logged into the social networks, data can be sent to the networks from websites with active social plugins. With an active plugin, a cookie with an identifier is set each time the website is called up. Since your browser sends this cookie along without being asked every time it connects to a network server, the network could in principle create a profile of which websites the user associated with the identifier has visited. And it would then also be entirely possible to re-assign this identifier to a person later – for example, when logging into the social network later. On our websites, we use the following plugins: Facebook, Twitter, and Pinterest. If you do not want social networks to collect data about you via active plugins, you can simply deactivate the social plugins on our websites with a click or select the "Block third-party cookies" function in your browser settings. In this case, the browser will not send any cookies to the server for embedded content from other providers. With this setting, however, other cross-site functions might possibly no longer work in addition to the plugins.
8.2 FACEBOOK
We use plugins from the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The link to Facebook's privacy policy can be found here: Facebook Privacy Policy.
8.3 TWITTER
We use plugins from the social network Twitter, which is operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA ("Twitter"). The link to Twitter's privacy policy can be found here: Twitter Privacy Policy.
8.4 PINTEREST
We use plugins from the social network Pinterest, which is operated by Pinterest Inc., 635 High Street, Palo Alto, CA, USA ("Pinterest"). The link to Pinterest's privacy policy can be found here: Pinterest Privacy Policy.
9. SOCIAL SIGN IN
We offer you the option of registering with us directly using your existing Facebook profile. If you wish to use this function, you will first be redirected to Facebook. There, you will be asked to log in with your username and password. We naturally do not gain any knowledge of your login data. If you are already logged into Facebook, this step is skipped. Afterwards, Facebook will inform you which data will be transmitted to us (public profile, friend list, email address, and current location). You confirm this with the "OK" button. We use the transmitted data to create your customer account, whereby your friend list is naturally not stored by us. A permanent link between your customer account and your Facebook account beyond this does not take place. For the purpose and scope of data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and setting options for protecting your privacy, please refer to the Facebook Privacy Policy.
10. SECURE DATA TRANSFER
Your personal data is transmitted securely to us through encryption. This applies to your order and also to the customer login. We use the SSL (Secure Socket Layer) coding system. Furthermore, we secure our websites and other systems against loss, destruction, access, modification, or distribution of your data by unauthorized persons through technical and organizational measures.
11. RIGHTS OF THE AFFECTED PERSON
According to the Federal Data Protection Act, our customers have, among other things, a right to free information about their stored data, as well as, if applicable, a right to correction, blocking, or deletion of data. We take the protection of your data very seriously. To ensure that personal data is not disclosed to third parties, please address your request by email or post, clearly identifying yourself, to: Ayara.de - Sami Akcamur - Alte Land Strasse 9 – D-78112 St. Georgen-
