Data protection is a matter of trust, and your trust is important to us. We respect your privacy and personal sphere. The protection and lawful collection, processing, and use of your personal data is therefore an important concern for us. To ensure you feel secure when visiting our websites, we strictly observe statutory provisions when processing your personal data and would like to inform you here about our data collection and data usage practices.
You can print or save this document by using the standard functionality of your internet browser (usually "File" -> "Save As"). You can also download and archive this document in PDF format by clicking here. To open the PDF file, you need the free Adobe Reader program (available at www.adobe.de) or comparable software that runs the PDF format. The following privacy policy explains which data is collected on our websites and how we process and use that data.
1. CONTROLLER
The controller responsible for the collection, processing, and use of your personal data within the meaning of the Federal Data Protection Act is Chice-Schuhe.de SE, Tamara-Danz-Str. 1, 10243 Berlin (hereinafter: Chice-Schuhe.de). If you wish to object to the collection, processing, or use of your data by Chice-Schuhe.de in accordance with these data protection provisions, either in total or for individual measures, you may send your objection via e-mail, fax, or letter to the following contact details: Chice-Schuhe.de - Sami Akcamur - Alte Land Strasse 9 – D-78112 St. Georgen - Tel: 07724-8844581 - e-mail: akcamur@outlook.com. Furthermore, you may of course request information about the data stored by us at any time free of charge (please see point 11 for this).
2. COLLECTION, PROCESSING, AND USE OF PERSONAL DATA
2.1 PERSONAL DATA
Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name, your telephone number, your address, and all master data that you provide to us when registering and creating your customer account. Statistical data that we collect, for example, when you visit our web shop and which cannot be directly linked to your person, does not fall under this category. Examples include statistics on which pages of our shop are particularly popular or how many users visit certain pages of the Chice-Schuhe.de shop.
2.2 CUSTOMER ACCOUNT
For every customer who registers accordingly, we set up password-protected direct access to their master data stored with us (customer account). Here, you can view data about your completed, open, and recently dispatched orders and manage your details and the newsletter. You undertake to treat your personal access credentials confidentially and not to make them accessible to unauthorized third parties. We cannot accept liability for misused passwords, unless we are responsible for the misuse. Unless you log out, you will remain logged in automatically. This function allows you to use some of our services (e.g., 'Your Ayara.de') without having to log in again each time. For security reasons, however, you will be prompted to enter your password again if, for example, you wish to change your personal data or place an order.
2.3 COLLECTION, PROCESSING, AND USE OF YOUR PERSONAL DATA
Data protection is very important to us. Therefore, when collecting, processing, and using your personal data, we strictly adhere to the legal provisions of the Federal Data Protection Act and the Telemedia Act. We collect, store, and process your data for the entire processing of your purchase, including any potential subsequent warranties, for our services, technical administration, and our own marketing purposes. Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract fulfillment or billing, or if you have previously consented. As part of order processing, for example, the service providers we use (such as carriers, logistics companies, banks) receive the necessary data for order and contract fulfillment. The data passed on in this way may only be used by our service providers to fulfill their task. Any other use of the information is not permitted and does not take place with any of the service providers entrusted by us. For your order, we require your correct name, address, and payment details. We require your e-mail address so that we can confirm receipt of your order and communicate with you. We also use it for your identification (customer login). Furthermore, you will receive your order and shipping confirmation via your e-mail address. Your personal data will be deleted provided that there are no statutory retention obligations to the contrary and if you have asserted a claim for deletion, if the data is no longer required for the fulfillment of the purpose pursued with the storage, or if its storage is inadmissible for other legal reasons.
2.4 USE OF YOUR DATA FOR ADVERTISING PURPOSES
In addition to processing your data to complete your purchase at Chice-Schuhe.de, we also use your data to communicate with you about your orders, certain products, or marketing campaigns, and to recommend products or services that might interest you. You can object to the use of your personal data for advertising purposes at any time, either in total or for individual measures, without incurring any costs other than the transmission costs according to the basic tariffs. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose.
2.4.1 NEWSLETTER
For the distribution of the newsletter, we use the so-called double opt-in procedure, i.e., we will only send you a newsletter via e-mail if you have previously expressly confirmed to us that we should activate the newsletter service. We will then send you a notification e-mail and ask you to confirm that you wish to receive our newsletter by clicking on a link contained in this e-mail. If you later decide you no longer wish to receive newsletters from us, you can object to this at any time without incurring any costs other than the transmission costs according to the basic tariffs. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every newsletter.
2.4.2 PRODUCT RECOMMENDATIONS VIA E-MAIL
As a Chice-Schuhe.de customer, you will regularly receive product recommendations from us via e-mail. You will receive these product recommendations from us regardless of whether you have subscribed to a newsletter. In this way, we want to provide you with information about products from our range that might interest you based on your recent purchases with us. We strictly comply with legal requirements in this regard. If you no longer wish to receive product recommendations or any promotional messages from us at all, you can object to this at any time without incurring any costs other than the transmission costs according to the basic tariffs. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every e-mail.
2.4.3 INDIVIDUAL ADVERTISING FOR YOU
Information we receive from you helps us to permanently improve your shopping experience and to make it customer-friendly and individual for you. The information transmitted by you and automatically generated is used to design advertising tailored to you and your interests. For this purpose, we use existing information, such as receipt and read confirmations of e-mails, information about your computer and connection to the Internet, operating system and platform, your order history, your service history, date and time of the visit to the homepage, and products you have viewed. We use this information exclusively in pseudonymized form. By analyzing and evaluating this information, we are able to improve our websites and our online offering and thereby send you individual advertising. This means advertising that recommends products that might actually interest you. Our goal is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the pseudonymized data collected from you helps us ensure that we do not send you indiscriminate advertising. Rather, we send you advertising, such as newsletters, product recommendations, or direct mail, that corresponds to your areas of interest. In this respect, for example, we also compare which of our advertising e-mails you open, in order to avoid sending you unnecessary e-mails. Chice-Schuhe.de uses the data provided by me and other information stored for my customer account, as well as pseudonymized usage data, to present me with personalized advertising and/or special offers and services. If you do not wish to receive personalized advertising, you can object to this at any time, either in total or for specific measures. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose.
2.4.4 SWEEPSTAKES, MARKET AND OPINION RESEARCH
In the case of sweepstakes, we use your data for the purpose of winner notification and advertising our offers. Detailed information can be found, if applicable, in our terms of participation for the respective sweepstakes. Furthermore, we use your data for market and opinion research. Of course, we use this exclusively in an anonymized form for statistical purposes and only for Ayara.de. Your responses to surveys will not be passed on to third parties or published. Chice-Schuhe.de uses and processes my personal data for market and opinion research for its own purposes. You may object to the use of data for market and opinion research at any time, either in total or for specific measures, without incurring any costs other than the transmission costs according to the basic tariffs. A notification in text form to the contact details mentioned in Section 1 (e.g., e-mail, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every survey e-mail.
3. CREDIT CHECK
We perform a credit check before concluding the purchase contract. This is done to be able to offer you a choice of different payment methods and at the same time to protect ourselves against payment defaults for purchases on account and by direct debit. Furthermore, the credit check serves your and our security, as it prevents fraud and other criminal offenses. As part of the credit check, we examine all data available to us and determine which payment methods can be offered for an order. This involves, among other things, checking all previous orders in your customer account. In addition, it is also checked whether the delivery address differs from the billing address, whether it is a new delivery address, or whether the order is to be delivered to a Packstation. In addition to the data available to us, data from external service providers is also required. For this purpose, we transmit the personal data required for a credit check (first and last name, your address, and, if applicable, your date of birth) to the following credit service provider: infoscore Consumer Data GmbH, Rheinstraße 99, 76532 Baden-Baden
This credit service provider uses the aforementioned data transmitted by us to carry out a corresponding assessment of your creditworthiness regarding the respective order based on mathematical-statistical procedures (scoring). Furthermore, the credit service provider uses the aforementioned data for other companies (e.g., other online retailers) for the purposes of address verification or identity checks, as well as for scoring applications based on this. Your address data is also included in the calculation of the probability value. Under certain circumstances, it may be possible to draw conclusions about hard negative characteristics. As part of the ordering process, we also compare your bank details (only IBAN and BIC or account number and bank sort code) with the Return-debit Prevention Pool (RPP) of infoscore Consumer Data GmbH (ICD), Rheinstr. 99, 76532 Baden-Baden. The RPP functions as a blocking file. Furthermore, in the event of non-redemption of a direct debit, as far as permissible, we will report your bank details (only IBAN and BIC, no personal information) to the RPP of the ICD, which will transmit this blocking notice to other companies participating in the inquiry procedure upon request. After payment of the returned direct debit, we will report the settlement to the RPP. If you do not agree with the payment method(s) offered to you, you can inform us in writing by letter or by e-mail to akcamur@outlook.com. We will then re-examine the decision while taking your point of view into account. You may revoke your consent at any time with effect for the future by notifying us in writing or in text form at akcamur@outlook.com, and you may also obtain information about the stored data from us and our credit service provider (at the addresses mentioned above).
4. COOKIES
Accepting cookies is not a prerequisite for visiting our websites. However, we would like to point out that our website and service have limited functionality if you do not allow us to set cookies.
What are cookies? Cookies are small files that are stored on your data carrier and save certain settings and data for exchange with our system via your browser. Basically, there are 2 different types of cookies: so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period or indefinitely. This storage helps us to design our websites and our offers according to your needs and facilitates your use by, for example, saving certain inputs so that you do not have to repeat them constantly.
Which cookies does Ayara.de use? Most of the cookies we use are automatically deleted from your hard drive after the end of the browser session (end of the session) (hence session cookies). Session cookies are required, for example, to offer you the shopping cart function across multiple pages. Furthermore, we also use cookies that remain on your hard drive. Upon a further visit, it is then automatically recognized that you have already been with us and which inputs and settings you prefer. These temporary or permanent cookies (lifespan of 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies, in particular, serve to make our offering more user-friendly, effective, and secure. Thanks to these files, it is possible, for example, that you are shown information on the page specifically tailored to your interests. The sole purpose of these cookies is to adapt our offering to your customer needs in the best possible way and to make your surfing experience with us as comfortable as possible.
What data is stored in the cookies? Only pseudonymous data is stored in the cookies used by Ayara.de. Upon activation of the cookie, an identification number is assigned to it, and no association of your personal data to this identification number is made. Your name, your IP address, or similar data that would allow an association of the cookie to you are not inserted into the cookie. Based on the cookie technology, we only receive pseudonymized information, for example, about which pages of our shop were visited, which products were viewed, etc.
What is onsite targeting? On the Chice-Schuhe.de websites, data is collected based on cookie technology to optimize our advertising and the entire online offering. This data is not used to identify you personally, but solely serves a pseudonymous evaluation of the use of the homepage. Your data is at no time merged with the personal data stored by us. With this technology, we can present you with advertising and/or special offers and services whose content is based on the information obtained in connection with clickstream analysis (for example, advertising aimed at the fact that only sports shoes were viewed in the last few days). Our goal is to make our online offering as attractive as possible for you and to present you with advertising that corresponds to your areas of interest.
Are there also third-party cookies? Ayara.de makes use of some advertising partners who help to make the Internet offering and the websites more interesting for you. Therefore, cookies from partner companies are also stored on your hard drive when you visit the websites. These are temporary/permanent cookies that delete themselves automatically after the specified time. These temporary or permanent cookies (lifespan of 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time. The cookies of our partner companies also contain only pseudonymous, and in most cases even anonymous, data. This includes, for example, data about which products you have viewed, whether something was bought, which products were searched for, etc. In this process, some of our advertising partners also collect information beyond the websites about which pages you have previously visited or which products you were interested in, for example, in order to be able to show you the advertising that corresponds best to your interests. This pseudonymous data is at no time merged with your personal data. They are exclusively intended to enable our advertising partners to provide you with advertisements that may actually be of interest to you.
Re-Targeting Our websites use so-called re-targeting technologies. We use these technologies to make our website more interesting for you. This technology allows internet users who have already shown interest in our shop and our products to be addressed with advertising on our partners' websites. We are convinced that the display of personalized, interest-based advertising is generally more interesting for the internet user than advertising that has no such personal connection. The display of these advertisements on our partners' sites is based on cookie technology and an analysis of previous usage behavior. This form of advertising is completely pseudonymous. No usage profiles are merged with your personal data. By using our site, you consent to the use of such cookies and the collection, storage, and use of your usage data. Furthermore, your data will be stored in cookies beyond the end of the browser session and can be retrieved, for example, during your next visits to the websites. You can revoke this consent at any time with effect for the future by refusing to accept cookies in your browser settings.
How can you prevent the storage of cookies?
You can set your browser so that it only accepts the storage of cookies if you agree to it. If you want to accept only the Chice-Schuhe.de cookies and not the cookies of our service providers and partners, you can select the "Block third-party cookies" setting in your browser. As a rule, the help function in the menu bar of your web browser will show you how to reject new cookies and switch off ones you have already received. Detailed information on how to change the settings in the browser you are using can be found at the following link. We recommend that if you use shared computers that are set to accept cookies and Flash cookies, you should always log out completely after finishing your session.
5. LOG FILES
With every access to the pages of Ayara.de, usage data is transmitted by the respective internet browser and stored in protocol files, so-called server log files. The data records stored in this process contain the following data: date and time of retrieval, name of the page called up, IP address, referrer URL (origin URL, from which you came to the websites), the amount of data transferred, as well as product and version information of the browser used. The IP addresses of the users are deleted or anonymized after the end of use. In the case of anonymization, the IP addresses are changed in such a way that the individual details about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person, or only with a disproportionately large amount of time, cost, and labor. We evaluate these log file records in anonymized form in order to further improve our offer and the Ayara.de shop and make them more user-friendly, to find and fix errors faster, and to manage server capacities. For example, it can be traced at what time the use of the Ayara.de shop is particularly popular and provide corresponding data volume to ensure the fastest possible shopping experience for you. In addition, we can also detect and rectify any errors in the Ayara.de shop more quickly by analyzing the protocol files.
6. WEB ANALYSIS
6.1 GOOGLE ANALYTICS
Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies," which are text files stored on your computer that allow an analysis of the use of our offer by Google. The information generated by the cookie about your use of our websites (including your IP address) is generally transmitted to and stored on a Google server in the USA. We would like to point out that Google Analytics has been extended on our websites by the code "gat._anonymizeIp();;" to ensure an anonymized collection of IP addresses (so-called IP masking). Your IP address is therefore only recorded by Google in abbreviated form at our request, which ensures anonymization and does not allow any conclusions to be drawn about your identity. In the event of activation of IP anonymization on our websites, your IP address will be truncated by Google beforehand within member states of the European Union or other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information to evaluate your use of our websites, to compile reports on website activities for us, and to provide further services associated with the use of websites and the internet to us. The IP address transmitted by your browser within the framework of Google Analytics will not be merged with other data from Google. A transfer of this data by Google to third parties only takes place due to legal regulations or within the framework of commissioned data processing. Under no circumstances will Google combine your data with other data collected by Google. By using these websites, you agree to the processing of data about you by Google and the previously described manner of data processing as well as the stated purpose. You can prevent the storage of cookies by a corresponding setting of your browser software; however, we would like to point out that in this case you may not be able to use all functions of our websites to their full extent. You can also prevent the collection of the data generated by the cookie and related to your use of these websites (incl. your IP address) to Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link. Further information on Google Analytics and data protection can be found at http://tools.google.com/dlpage/gaoptout?hl=de.
6.2 WEBTREKK
For the statistical evaluation of the websites, we also use the technologies of Webtrekk GmbH, Boxhagener Str. 76-78, 10245 Berlin (www.webtrekk.de). With the help of Webtrekk services, we collect statistical data about the use of our website. This data is used to permanently improve and optimize the Chice-Schuhe.de shop and our offers and thus make them more interesting for you. Webtrekk GmbH has been certified by TÜV Saarland in the field of data protection for the web controlling software used by Chice-Schuhe.de. In particular, the collection and processing of tracking data was checked and certified for data protection compliance and data security. As part of the use of these websites, information transmitted by your browser is collected and evaluated. This is done through a cookie technology and so-called pixels that are integrated into every webpage. The following data is collected: Request (file name of the requested file), browser type/version, browser language, operating system used, inner resolution of the browser window, screen resolution, Javascript activation, Java on/off, cookies on/off, color depth, referrer URL, IP address (is collected exclusively in anonymized form and deleted immediately after its use), time of access, clicks, order values, shopping carts, and anonymized form contents (for example, whether a phone number was provided or not). A direct personal reference is excluded at all times. The data collected in this way is used to create anonymous usage profiles, which form the basis for web statistics. The data collected with the Webtrekk technologies will not be used to personally identify the visitor of these websites without the separately granted consent of the person concerned and will at no time be combined with personal data about the bearer of the pseudonym. Data collection and storage by Webtrekk can be objected to at any time with effect for the future. For this purpose, please call up the following link. By confirming the link, a so-called opt-out cookie is placed on your data carrier. This cookie is valid for 5 years. Please note that if all cookies on your computer are deleted, this opt-out cookie will also be deleted, i.e., if you still want to object to the anonymized data collection by Webtrekk, you must set the opt-out cookie again. The opt-out cookie is set per browser and computer. If you visit our websites from home and at work or with different browsers, you must activate the opt-out cookie in the various browsers or on the various computers.
7. DOUBLECLICK BY GOOGLE
Doubleclick by Google is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Doubleclick by Google uses cookies to present you with relevant advertisements. A pseudonymous identification number (ID) is assigned to your browser to check which ads have been displayed in your browser and which ads have been called up. The cookies do not contain any personal information. The use of DoubleClick cookies merely enables Google and its partner websites to place advertisements based on previous visits to our or other websites on the internet. The information generated by the cookies is transmitted by Google to a server in the USA for evaluation and stored there. A transfer of data by Google to third parties only takes place due to legal regulations or within the framework of commissioned data processing. Under no circumstances will Google combine your data with other data collected by Google. By using our websites, you agree to the processing of data about you by Google and the previously described manner of data processing as well as the stated purpose. You can prevent the storage of cookies by a corresponding setting of your browser software; however, we would like to point out that in this case you may not be able to use all functions of our websites to their full extent. You can also prevent the collection of the data generated by the cookies and related to your use of the websites to Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link under the item DoubleClick Deactivation Extension. Alternatively, you can deactivate the Doubleclick cookies on the Digital Advertising Alliance page under the following link.
8. SOCIAL PLUGINS
8.1 SOCIAL PLUGINS
Our website uses social plugins ("plugins") from various social networks. With the help of these plugins, you can, for example, share content or recommend products. The plugins on Chice-Schuhe.de are deactivated by default and therefore do not send any data. You can activate the plugins by clicking on the "Activate Social Media" button. Of course, the plugins can be deactivated again with a single click. When these plugins are activated, your browser establishes a direct connection to the servers of the respective social network as soon as you call up a page of our website. The content of the plugin is transmitted by the social network directly to your browser and integrated by it into the website. By integrating the plugins, the social network receives the information that you have called up the corresponding page of our website. If you are logged into the social network, it can assign the visit to your account. If you interact with the plugins, for example by clicking the Facebook "Like" button or submitting a comment, the corresponding information is transmitted directly from your browser to the social network and stored there. For the purpose and scope of the data collection and the further processing and use of the data by social networks as well as your rights in this regard and settings options for protecting your privacy, please refer to the data protection notices of the respective networks or websites. You will find the links to these below. Even if you are not logged into the social networks, data can be sent to the networks from websites with active social plugins. Through an active plugin, a cookie with an identifier is set every time the website is called up. Since your browser sends this cookie with every connection to a network server without being asked, the network could in principle use it to create a profile of which websites the user belonging to the identifier has called up. And it would then also be quite possible to assign this identifier to a person later - for example, when logging into the social network later. On our websites, we use the following plugins: Facebook, Twitter, and Pinterest. If you do not want social networks to collect data about you via active plugins, you can either simply deactivate the social plugins on our websites with a click or select the "Block third-party cookies" function in your browser settings. In that case, the browser will not send any cookies to the server for embedded content from other providers. With this setting, however, other cross-site functions may also no longer work in addition to the plugins.
8.2 FACEBOOK
We use plugins of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). You can find the link to Facebook's privacy policy here: Facebook Privacy Policy.
8.3 TWITTER
We use plugins of the social network Twitter, which is operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA ("Twitter"). You can find the link to Twitter's privacy policy here: Twitter Privacy Policy.
8.4 PINTEREST
We use plugins of the social network Pinterest, which is operated by Pinterest Inc., 635 High Street, Palo Alto, CA, USA ("Pinterest"). You can find the link to Pinterest's privacy policy here: Pinterest Privacy Policy.
9. SOCIAL SIGN IN
We offer you the possibility to register with us directly using your existing Facebook profile. If you wish to use this function, you will first be redirected to Facebook. There, you will be asked to log in with your username and password. We naturally do not gain any knowledge of your login data. If you are already logged into Facebook, this step is skipped. Afterwards, Facebook will inform you which data will be transmitted to us (public profile, friends list, email address, and current place of residence). You confirm this with the "OK" button. We use the transmitted data to create your customer account, although your friends list is, of course, not stored by us. No further permanent connection between your customer account and your account at Facebook takes place. For the purpose and scope of the data collection and the further processing and use of the data by Facebook as well as your rights in this regard and settings options for protecting your privacy, please refer to the Facebook Privacy Policy.
10. SECURE DATA TRANSMISSION
Your personal data is transmitted securely by us using encryption. This applies to your order as well as the customer login. We use the encryption system SSL (Secure Socket Layer). Furthermore, we protect our websites and other systems through technical and organizational measures against loss, destruction, access, alteration, or dissemination of your data by unauthorized persons.
11. RIGHTS OF THE AFFECTED PERSON
According to the Federal Data Protection Act, our customers have, among other things, a right to free information about their stored data, as well as, if applicable, a right to correction, blocking, or deletion of data. We take the protection of your data very seriously.
